I. FAMILY RELATED PROCEDURES :

Divorce/Dissolution of Marriage

To file for a simplified divorce
* Both parties must sign the Petition.
* Both parties must appear at final hearing.
* Both parties must file a notarized Financial Affidavit.
* Both parties must waive alimony.
* Both parties must complete and sign a Marital

Settlement Agreement.
* Parties may not have children in common.

Divorce by Publication

With Children and or Property

* Divorce by publication is used when the whereabouts
of the other party is unknown.

* Notice of action for divorce is published in a common newspaper for 4 consecutive weeks providing notice of action by constructive service.

* Divorces with children or property require both parties attempt to enter into a Marital Settlement Agreement agreeing to all matters regarding their children or property. Service by a certified process server, or a signed Answer with address and phone number from the other party is also required. Disclosure of Financial information by both parties is exchanged by completing a Financial Affidavit. If the parties do not enter into a Marital Settlement Agreement the court typically orders both parties to attend mediation. The court strongly encourages the parties to enter into a settlement agreement. If the parties are unable to reach a signed agreement the judge will eventually set your case for a Contested Final Hearing and make all the important decisions about your life for you. The court strongly encourage the parties enter into a Settlement Agreement that is mutually beneficial for all parties involved.

Settlement Agreements

A Settlement Agreement is a signed agreement between you your spouse spelling out all important matters. These matters may include but are not limited to: the distribution of assets and debts, custody and visitation of the children, child support, alimony and many other important issues. You and your spouse may enter into a Marital Settlement Agreement either before filing your case (pre-suit), or as soon as you have reached an agreement with your spouse on what you want to do regarding children, real estate, or whatever your situation may be. The Judge may also order you and your spouse to attend Mediation. If you are unable to reach a Settlement Agreement at mediation, the Judge will set your case for a contested final hearing. At the final hearing the Judge will rule on issues regarding custody, child support, distribution of marital property and all other matters deemed relevant by the Court and may enter a Final Judgment of Dissolution of Marriage.

A Modification is a request to change something in the final judgment such as child support, custody, visitation, etc.
